DENR-EMB halts Pueblo de Oro project over ECC misrepresentation in CDO

CAGAYAN DE ORO CITY — The Department of Environment and Natural Resources – Environmental Management Bureau (DENR-EMB) Region 10 has ordered the suspension of the Environmental Compliance Certificate issued to Pueblo de Oro Development Corporation for its proposed Masterson Mile North Project in Upper Carmen.

The agency said all activities tied to ECC No. ECC-R10-2506-0002 must stop immediately while compliance issues are addressed. The suspension follows a review prompted by concerns raised by affected residents.

Findings cite material misrepresentation

DENR-EMB found the developer liable for three counts of material misrepresentation in its ECC application. These include the use of cancelled and outdated land titles despite awareness of updated subdivision plans, and the failure to disclose that a portion of the site covered by TCT No. T-157054 is reserved for public road widening.

The bureau also cited inaccurate site development information that affected assessments on traffic, drainage, and setback requirements. DENR-EMB said the omissions violated the EIS Procedural Manual under DAO 2003-30 and Presidential Decree 1586, which mandate complete and accurate disclosure in environmental impact evaluations.

Cease-and-desist order and penalties

Along with the suspension, DENR-EMB imposed a ₱150,000 fine for misrepresentation. The agency warned that non-compliance or proof of willful deception could result in the permanent cancellation of the ECC and additional legal action.

The decision acknowledged the petition filed by the Morning Mist Village Homeowners Association, underscoring that environmental safeguards and due process take precedence. DENR-EMB said the action prevents premature development until the proponent demonstrates full compliance with environmental requirements.
